You have been directed to this page because you have complained to us about a listing on our spam pages which mentions your organisation's name and/or Internet domain.

Before you make threats of legal action or demands for compensation, you should read this page very carefully. You must read it in conjunction with our email reply to your complaint, which includes facts specific to your case.

You should also show our email reply and this web page to your legal counsel, if you have one.

Statement of Facts

You are listed because you or your organisation sent unsolicited bulk email to our private email addresses without our permission. This is an invasion of our privacy and an unauthorised use of our computer resources.

You sent unsolicited bulk email to us.: We did not request information from you or your company, either directly or indirectly. We did not "opt-in" to any mailing list associated with, or used by, you or your company.
You used our private email address without our consent.: The email address to which you sent the unsolicited email is a private address. It is not in the public domain. You obtained and used this address without our consent. The existence of our private email address on any mailing list, whether you compiled it yourself or whether you obtained it from a third party, does not constitute consent on our part to receive unsolicited bulk email from you or your company.
We have a clearly-stated policy on unsolicited bulk email.: We make our policy on unsolicited bulk email very clear on our web site. If you had researched our organisation before sending your unsolicited bulk email, you would have been aware that we take vigorous action against those who send such email to us.
We have followed our standard procedure.: We follow the same procedure on receipt of all unsolicited bulk email. You have not been given any special treatment.
We always notify the upstream Internet service provider(s).: On receipt of an unsolicited bulk email, we always make a complaint to the upstream Internet service provider(s) of the person or organisation which sent the message. If you have violated the terms of service of your ISP by sending an unsolicited bulk email, then your ISP is within its rights to suspend, restrict or terminate the service which it provides to you. This is your problem, not ours.
We make no comment on the product or service described in the unsolicited bulk email.: At our web site, we simply list the headers of the unsolicited bulk email which you sent to us, together with the names of the organisations to whom we sent our complaint, and their responses (if any). We make no comment on the products or services which were described or advertised in the unsolicited bulk email.
We do not use "remove me" or "unsubscribe" links or addresses listed in unsolicited bulk email.: Some unsolicited bulk emails include a "remove me" or "unsubscribe" link or email address. We never reply to such an email address. Many are bogus. Some are the addresses of innocent third parties who are completely unconnected with the unsolicited bulk email. Others are used by the sender of the message to confirm that the recipient's email address is valid. A few are legitimate "unsubscribe" addresses, but since we did not subscribe to receive the unsolicited bulk email in the first place, we feel no obligation to use them. In any case, it is impossible to know which ones are legitimate.
The contents of unsolicited bulk email are in the public domain.: Unsolicited bulk email are, by definition, sent indiscriminately and without prior consent to recipients who are not known personally to the sender. This is equivalent to posting an advertisement on a public bulletin board, web page or newsgroup. The sender cannot, therefore, claim that the contents of the unsolicited bulk email are private or confidential. Consequently, we consider the contents of all unsolicited bulk email to be in the public domain. This gives us the right to publish them in part or in full.
We take no action to increase the visibility of our spam pages at search engine or directory web sites.: When your company name or domain is entered as the search term at sites such as Google or Yahoo, our spam listing may appear in the results alongside your own web site, or even above it. We take no deliberate action to cause this to happen. We do not include any keyword meta-tags in our spam pages, nor do we submit these pages explicitly to the search engine sites. You should note that search engine sites such rarely remove web sites from their databases in response to complaints from third parties.
We do not respond positively to threats.: You violated our privacy and made unauthorised use of our computer resources, so we listed you on our spam pages. Now you're threatening us directly. Be aware that details of your threats may also be listed on our spam pages and posted to the appropriate Usenet newsgroup news.admin.net-abuse.*.
